You have received a positive decision on your asylum application. This means you are allowed to stay in Austria and receive protection.

What does this decision mean for you?

A positive decision means that the authorities have decided that you need protection. You will receive a protection status and can stay legally in Austria.

There are different types of protection:

You receive refugee status if you cannot return to your country because you fear persecution.

This can be because of your:

  • race
  • religion
  • nationality
  • membership of a particular social group or
  • political opinion

You receive subsidiary protection if you do not qualify as a refugee, but you would face serious harm if you return to your country. This can include:

  • risk to your life
  • torture or inhuman treatment
  • serious danger because of war or violence

In some cases, you may receive a residence permit for humanitarian or special reasons under Austrian asylum law.

This can happen if you cannot return to your home country because your basic human rights would be at risk (for example, protection against inhuman treatment or the right to respect for private and family life). You may also receive a residence permit if you are a victim of violence or if you are needed as a witness in a criminal case.

Can the protection status be withdrawn?

In some cases, your protection status can be taken away. This can happen if the authorities find that:

  • You no longer meet the conditions for refugee status or subsidiary protection.
  • You obtained your protection through false information or documents.
  • You are convicted by a final judgment of a particularly serious crime and constitute a danger to security.

If your status is withdrawn, your residence permit can also be revoked. The authorities must follow national law and give you a chance to respond before making a final decision.
